THE UPHILL BATTLE BEGINS IN SENATE

The New Mexico Alliance for Life thanks the the New Mexico House Judiciary Committee for voting 7-6 to move the Late-Term Abortion Ban (HB390) and Parental Notification (HB391) Bills out of committee and over to the House Floor for a full House vote.  Those voting "YES" were Rep. Zach Cook (R-Ruidoso), Rep. Paul Pacheco (R-ABQ), Rep. David Adkins (R-ABQ), Rep. Cathrynn Brown (R-Carlsbad), Rep. Jim Dines (R-ABQ), Rep. Nate Gentry (R-ABQ), Rep. Terry McMillian (R-ABQ).   Opponents of the bill who voted to keep abortion legal through all nine months of pregnancy include "NO" votes from Rep. Kenny Martinez (D-Grants), Rep. Eliseo Alcon (D-Milan), Rep. Antonio "Moe" Maestas (D-ABQ), Rep. Georgene Louis (D-ABQ), Rep. Gail Chasey (D-ABQ) and Rep. Brian Egolf (D-Santa Fe).

Call to Action: Pro-Life Bills Head to House Judiciary Committee & More

Last week, the House Regulatory & Public Affairs Committee voted 4-3 to move the Late-Term Abortion Ban Act (HB 390) and the Parental Notification of Abortion Act (HB 391) out of committee and over to the House Judiciary committee.  The House Judiciary committee will hear both bills starting at 1:30 PM on Friday, February 27th in either room 307 or 309.  Please plan on being there as early as possible, as the pro-abortion paid activists will be there very early.  As New Mexicans, we know that abortion up to the day of birth--for any reason has no place in our state. There is no justifiable reason for elective late-term abortion to be taking place in our backyard, its common sense  to end this barbaric practice that still only exists in places like North Korea and China--and the vast majority of Americans agree.  We also know that on a straight up or down question, the people of Albuquerque support a 20 week ban on abortion 55% to 39% according to an Albuquerque Journal poll.  Planned Parenthood spent over 1 million dollars to buy the 20 week ban election in Albuquerque and confuse voters.  Let's make sure they don't buy votes this time.

Former abortionist now pro-life Las Cruces OB-GYN, Dr. Anthony Levatino and the only medical doctor in the state Legislature, Rep. Terry McMillan both support these common-sense proposals to bring New Mexico in line with other states, majority of countries that outlaw abortion after five months of pregnancy 

Albuquerque- Dr. Anthony Levatino, a well-known former abortion provider now pro-life OB-GYN practicing in Las Cruces, announced his support for the Late-Term Abortion Ban (HB390) and the Parental Notification for Abortion Bill (HB391). After performing more than 1,200 abortions, Dr. Levatino knows first-hand the horrors that occur during abortions on unborn children after five months of pregnancy. These bills will protect the lives of women and unborn children who could electively be aborted after have reaching viability or around the gestational age of past five months and require doctors alert parents before an underage girl undergoes an abortion. 

"As a doctor, you know that these are children; you know that these are human beings with arms and legs and heads and they move around and they are very active," Dr. Levatino said. "When the abortionist finishes a suction D & C he has to literally reassemble the child."

According to the consent form from Albuquerque's late-term abortion facility, Southwestern Women's Option, obtained by New Mexico Alliance for Life, abortion after 18 weeks  is more dangerous than natural birth. Additionally, Dr. Levatino, stated it is "neither simple nor safe." Currently, New Mexico is one of the few states lacking restrictions on abortions, making Albuquerque home to one of four facilities in the U.S. that perform abortions until the day of birth.  

Along with Dr. Levatino, Rep. Terry McMillan, the only medical doctor in the New Mexico Legislature, supports the measures. "I believe that like me, most New Mexicans would at least like to know that when an abortion is performed, it is not perpetuated on an infant that would otherwise be viable in today's medical environment," Rep. McMillan said in regard to HB390, the Late-Term Abortion Ban Act. 

Both bills are scheduled for their first committee hearing on Friday, February 20 at 1:30 p.m. in the House Regulatory & Public Affairs Committee, room 315.

This is Late-Term Abortion in New Mexico

Late-Term Abortion in New Mexico has proven to be dangersome and unsafe for the women that travel from all across the country to obtain these risky procedures. Below is a consent form from the nation's largest late-term abortion clinic, located in Albuquerque New Mexico, which clearly states that abortion after 18 weeks of pregnancy involves "greater risks" than carrying the pregnancy to term.

There are 2 different Late-Term Abortion procedures. One is called D&E (Dilation & Evacuation). D&E is a procedure where a fetus is dismembered limb by limb and his/her head is crushed in order to remove it from the vaginal canal. This procedure is described by Dr. Levatino in front of the US Congress which you can watch HERE

The other procedure used during a late-term abortion is performed by using the M.O.L.D. technique. The M.O.L.D. technique includes a series of medications and an injection into the fetus' brain or heart to induce a fetal heart-attack. This procedure is described in the videos below.

This Friday! First of Four Committee Hearings for Pro-Life Legislation

The first of four committees hearings is this FRIDAY, February 20 in the House Regulatory & Public Affairs  Committee for the Late-Term Abortion Ban Act, HB 390 sponsored by Rep. Yvette Herrell (R, Alamogordo) and the Parental Notification of Abortion Act HB 391 sponsored by Rep. Alonzo Baldonado (R, Los Lunas).  

New Mexico Alliance for Life expects the bills to pass this committee and then go on to the next House Committee then on to the House Floor.

HOWEVER....
 After passing the House, the bills will then go through TWO more committees on the Senate side, then onto the Senate Floor and off to Governor Susana Martinez's desk to be signed into law. But this won't happen unless WE, as the pro-life community, show our support at the Capitol for these bills. 

We know that the abortion industry will be there in full force to try to kill these bills. If you can be at the hearing at Friday at 1:30 p.m. in Room 315, that would be helpful to the cause. Plan on getting there an hour before to ensure you get a seat in the committee room. 

Thankfully we believe that we have the votes on the Regulatory & Public Affairs committee to pass this bill with the support of committee members Rep. Yvette Herrell, Rep. Bob Wooley, Rep. Nora Espinoza and Rep. James Smith.



HOWEVER, we can take nothing for granted. 
This is why are  also asking folks to reach out to Rep. Debbie Armstrong, Rep. Patricia Roybal Caballero and Rep. D. Wonda Johnson to let them know New Mexicans want to see these bills pass to protect innocent, viable unborn children from death by abortion and to require parental notification before an underage girl undergoes an invasive surgical procedure.

"This legislation addresses the fact that elective late-term abortions in New Mexico are neither safe nor rare, and the majority of New Mexicans believe that unborn children at the point of viability deserve protection," said Rep. Herrell. "We look forward to the day where these unborn children are protected and there are safer solutions for women rather than risky late-term abortions." 

This bill addresses elective late-term abortions that are performed up to the day of birth on healthy mothers and includes exceptions for a woman's health and safety or rape, incest or abuse. 

"New Mexicans do not want to see abortions performed until the day of birth in our state," said Elisa Martinez, president of New Mexico Alliance for Life. "New Mexico has become a hotbed for abortion businesses setting up in our state because of the lack of any common-sense protections for women and girls from abortion, especially late-term abortions which are more dangerous than giving birth."  

A recent Albuquerque Journal Editorial, stated "just 14 percent thought abortion should be legal in the last three months of pregnancy and 80 percent opposed it."

Currently, Albuquerque is home to one of only four late-term abortion facilities in the U.S. and believed to be the largest with out-of-state doctors flying into New Mexico weekly to preform lucrative late-term abortions. In October, an out-of-state abortion business owner announced  the opening of a new abortion facility in Las Cruces because of the tightening of abortion laws in other states.

House Majority Whip Representative Alonzo Baldonado (R-Los Lunas) introduced the Parental Notification Bill which requires abortion providers notify a minor child's parent 48 hours before their underage daughter undergoes an abortion. This bill is backed by both Republicans and Democrats. In cases where pregnancy is the result of rape, invest or sexual abuse, CYFD is notified to investigate and protect the minor. Once CYFD confirms that the pregnancy is from rape, insist or sexual abuse, parental notification is waived. 

"In school, you need parental notification to administer aspirin; it's common-sense to notify parents is their child is about to undergo a major medical procedure," Rep. Baldonado said. 

Democrat Rep. Jim Trujillo (D-Santa Fe) added, "This is about protecting life. This is a very common-sense and pragmatic way to go about it." 

The Late-Term and Partial Birth Abortion act will add a new section prohibiting late-term abortions to the existing partial birth abortion ban act.  It prohibits abortions after 20 weeks (about five months of pregnancy) and affirms that only a physician may perform an abortion.  There is a presumption of viability at 20 weeks, which can only be overcome by a physician's objective testing consistent with recent Supreme Court rulings defining viability.  There are exceptions to the prohibition where the life and health of the mother is at risk. If this exception is used, however, the physician must attempt to save the life of the unborn baby.  There is another exception based on rape, incest or abuse.  The new statute will impose civil penalties on the physician who violates the act. There is a minimum of one year suspension of the physician's license and at least a $5,000 fine.

If a physician performs an abortion on a minor without notification, the doctor will face civil penalties of at least $5,000. Additionally, the doctor's license will be taken away for at least a year. 

Penalties for both bills apply to only to the doctor.

KRQE: Late-Term Abortion Ban has Bipartisan Support at Roundhouse

SANTA FE (KRQE) – It doesn’t seem like that long ago that Albuquerque became the center of the national abortion debate. Now, New Mexico itself is set to be front and center.

On Friday, lawmakers announced a new bill to ban late term abortions in a state with one of the only known late-term abortion clinics in the nation. The bill would ban abortions after five months and once the fetus is capable of living outside the womb.

Unlike the failed November 2013 measure in Albuquerque, the bill provides exceptions for rape, abuse, incest, and when the mother’s life is in danger.

Republicans announced the measure, sponsored by Rep. Yvette Herrell, R-Albuquerque, already had the support of six House Democrats.

“Forty-two other states have laws on the books like this already, and I think that’s what really garnered the bipartisan support,” said Rep. Monica Youngblood, R-Albuquerque.

But the GOP is in for a fight with other Democrats.

“There are very difficult, complicated decisions in regards to abortion,” said Rep. Deborah Armstrong, D-Albuquerque. “Government and politics have no roll [in it].”

Not all faith-based groups agree, either.

“We believe that these are deeply complex and personal decisions that should be made by a woman, with her family, according the advice or her doctor and, of course, according to her own faith and values,” said Joan Lamunyon Sanford, executive director for NM Religious Coalition for Reproductive Choice.

With the bill set to be introduced on Monday, supporters say it is a long-overdue bill that has a much better chance at passing than the Albuquerque measure, which failed on a 45% to 55% vote.

“We know that the majority of New Mexicans do not want to have elective late-term abortions taking place up to the day of birth in our state,” said Elisa Martinez with New Mexico Alliance for Life.

Gov. Susana Martinez says she’s pro-life and doesn’t support late-term abortions.

Another bill announced on Friday would require teens give their parents 48 hours notice before they get an abortion.

If a doctor performed an abortion on a minor and a parent didn’t know, the doctor could be fined and have their license suspended for a year.

Herrell. "We look forward to the day where these unborn children are protected and there are safer solutions for women rather than risky late-term abortions." 

This bill addresses elective late term abortions that are performed on healthy mothers and includes exceptions for a woman's health and safety or rape, incest or abuse. 

"New Mexicans do not want to see abortions performed until the day of birth in our state," said Elisa Martinez, president of New Mexico Alliance for Life. "New Mexico has become a hotbed for abortion businesses setting up in our state because of the lack of any common-sense protections for women and girls from abortion, especially late-term abortions which are more dangerous than giving birth."  

With the support of Governor Susana Martinez, the New Mexico Catholic Bishops and many leaders in the state Senate and state House of Representatives, the time has never been better to pass legislation that has overwhelming support from New Mexicans. A recent Albuquerque Journal Editorial, stated "just 14 percent thought abortion should be legal in the last three months of pregnancy and 80 percent opposed it."

Currently, Albuquerque is home to one of only four late-term abortion facilities in the U.S. and believed to be the largest with out-of-state doctors flying into New Mexico weekly to preform lucrative late-term abortions. In October, an out-of-state abortion business owner announced  the opening of a new abortion facility in Las Cruces because of the tightening of abortion laws in other states. 

House Majority Whip Representative Alonzo Baldonado (R-Los Lunas) introduced the Parental Notification Bill which requires abortion providers notify a minor child's parent 48 hours before their underage daughter undergoes an abortion. This bill is backed by both Republicans and Democrats. In cases where pregnancy is the result of rape, invest or sexual abuse, CYFD is notified to investigate and protect the minor. Once CYFD confirms that the pregnancy is from rape, insist or sexual abuse, parental notification is waived. 

"In school, you need parental notification to administer aspirin; it's common-sense to notify parents is their child is about to undergo a major medical procedure," Rep. Baldonado said. 

Democrat Rep. Jim Trujillo (D-Santa Fe) added, "This is about protecting life. This is a very common-sense and pragmatic way to go about it." 

The Late-Term and Partial Birth Abortion act will add a new section prohibiting late-term abortions to the existing partial birth abortion ban act.  It prohibits abortions after 20 weeks (about five months of pregnancy and affirms that only a physician may perform an abortion.  There is a presumption of viability at 20 weeks, which can only be overcome by a physician's objective testing consistent with recent Supreme Court rulings defining viability.  There are exceptions to the prohibition where the life and health of the mother is at risk. If this exception is used, however, the physician must attempt to save the life of the unborn baby.  There is another exception based on rape, incest or abuse.  The new statute will impose civil penalties on the physician who violates the act. There is a minimum of one year suspension of the physician's license and at least a $5,000 fine.

If a physician performs an abortion on a minor without notification, the doctor will face civil penalties of at least $5,000. Additionally, the doctor's license will be taken away for at least a year. 

Penalties for both bills apply to only to the doctor.
