Congressional Investigative Panel's First Hearing on Bioethics & Fetal Tissue as UNMHSC Harvested   Heart Vessels from 57 Babies Aborted at Late-Term Clinic Owned By UNM Professor Curtis Boyd

Wednesday, Congresswoman Marsha Blackburn announced the first hearing of the Select Investigative Panel on Infant Lives will be held on Wednesday, March 2. Members of the panel will hear testimony from expert witnesses on the issue of bioethics and fetal tissue. This comes as citizens across the state along with New Mexico Alliance for Life have serious concerns regarding the ethics of harvesting organs, body parts and tissue from aborted infants used at the University of New Mexico Health Sciences Center (UNMHSC) for research, especially as the university continues to withhold public documents surrounding this issue.
 
"UNMHSC's research studies involving organs, body parts and tissue from aborted babies up to 24 weeks gestation gives rise to many ethical concerns, especially considering UNM's lack of documents evidencing their protocols and procedures," said Elisa Martinez, NMAFL executive director. "The UNM study using heart vessels from 57 babies harvested within 30 minutes of the abortion procedure raises serious ethical concerns and highlights the need for the Congressional panel's investigation, as UNM professor Curtis Boyd performs the abortions in his private clinic and is then thanked in UNMHSC studies as tissue collector, when does one role end and the other begin?" 

Arthur Caplan, director of the New York University Langone Medical Center's Division of Medical Ethics, who was quoted in Live Science, referred to fetal tissue research as "the ticking time bomb of medical ethics," and argues that fetal tissue donation at abortion clinics presents a conflict of interest for clinicians because it "shifts the focus away from women and their needs."
 
The study obtained by NMAFL (view here) explicitly references different aspects of the abortion procedure, which questions if there was any separation between the harvesting of organs and the abortion procedure.
 The incentive for abortionists to harvest organs for research, which is often funded by private and taxpayer grants, presents an alarming bioethical concern.

The scientific merit of the UNM study is also suspect. Dr. David Prentice, a stem cell research expert states after reviewing, "The results are strictly theoretical and make no headway toward actual knowledge of whether the genes studied may work in humans toward closure of the ductus arteriosus at birth.  Not of much practical value." Martinez asks, "If these studies have little scientific merit, why go to great lengths to harvest body parts from aborted babies--are the millions of taxpayer dollars in research grants an incentive to harvest body parts for research at UNM, which may also compromise women's health in the process?"

New Mexico Alliance for Life Attorney Files Lawsuit Against UNM Health Sciences Center, Withholding Documents on Study Involving Extracted Eyes of Aborted Babies Up to 24 Weeks Gestation Harvested from Southwestern Women's Options

Additionally: 
Congressional Select Investigative Panel Issues Subpoenas to Uncooperative Organizations UNMHSC and ABQ's Late-Term Abortion Center

The University of New Mexico Health Sciences Center is not being transparent about its aborted fetal research program and is either breaking state open records law by withholding documents they are required to maintain by federal regulation- or potentially breaking federal law by not maintaining the documents.  NMAFL's attorney filed a lawsuit with District Court in order to obtain documents UNM is required to maintain pursuant to federal regulation originally requested in January, as covered in the Albuquerque Journal today.  

NMAFL previously confirmed that UNMHSC is harvesting baby body parts... including eyes, brains, livers, hearts, kidneys... from aborted babies at Southwestern Women's Options, one of the only abortion clinics in that nation that performs abortion until the day of birth for ANY reason.

UNMHSC has ALSO not been cooperative with the Congressional Select Investigative Panel on Infant Lives led by Congresswoman Marsha Blackburn, who had to subpoena UNM HSC and Curtis Boyd's Southwestern Women's Options in order to obtain documents originally requested regarding the practices of UNMHSC's human research programs, arrangements with Curtis Boyd who also serves as UNM "Assistant Clinical Professor" and their practices of harvesting fetal tissues of late-term babies from his clinic.

Pursuant to the state Inspection of Public Records Act (IPRA), NMAFL has requested documents specifically cited in this study funded by taxpayers through the UNM Dept. of Pediatrics and the National Institutes of Health (NIH). 

NMAFL's IPRA request cited the 2015 study: 
"VEGF mRNA and Protein Concentrations in the Developing Human Eye"

  • Study led by UNMHSC researcher Robin Ohls, published in April 2015- within the three year timeframe required by law for NIH studies maintenance of documents. 
  • No confidential information has been sought by NMAFL regarding documents involving patients or their personal identifying information from Southwestern Women's Options. 

Some of the documents requested by NMAFL, required by federal law to be maintained by UNMHSC regarding the 2015 study: 


* Redacted consent to donate forms women are required to be informed of-- whether their babies' bodies will be harvested for parts and used for research.
* Biohazard compliance for  the storage and transfer of body parts, eyeballs, organs and other tissues of aborted babies from UNM's Associate Clinical Professor, Curtis Boyd, owner of Southwestern Women's Options.
* Human Research Review Committee (HRRC) determinations of Human Eye Study as a "non-human" study cited in the Human Eye Study. 

RESPONSE FROM UNM TO NMAFL'S OPEN RECORDS REQUEST: 

"UNM Health Science Center has confirmed they did not identify any records specifically responsive to your request as it pertains to the study...However HSC will continue to search and should they locate such documents specific to your request they will provide them as soon as possible."  

Federal regulation 45 C.F.R. 46.115 states, "that records relating to research which is conducted shall be retained for at least three years after completion of the research.  All records shall be accessible for inspection by authorized representatives of the department or agency." 

NMAFL also discovered that UNMHSC has its own standard operating procedures, designed by Dr. Richard Larson, vice chancellor of UNMHSC research, for identifying and accessing files from studies such as checklists, protocol files, meetings of approvals, as well policies and procedures for conducting studies that must be maintained pursuant to federal statute 45 CFR 46.115.

"UNMHSC's shroud of secrecy around its aborted fetal research program is why New Mexico Alliance for Life welcomes the congressional investigation. NMAFL and the public are entitled to examine documents about this program pursuant to state open records laws, and UNMHSC is required to maintain documents regarding its aborted fetal program pursuant to federal law, documents UNMHSC has withheld for public inspection to date from our open records request. UNMHSC is either violating federal law, by not maintaining documents required or breaking state law by withholding specific documents requested from the 2015 study using extracted eyeballs from babies aborted up to 24 weeks gestation from late-term abortionist Curtis Boyd."

Dr. Paul Roth, chancellor of the UNMHSC and dean of UNM School of Medicine, serves as the institutional official for the Health Sciences Center's human research protections program and is responsible for the institution's compliance with applicable (federal) laws, rules and regulations as they relate to research involving human subjects. However, NMAFL finds UNMHSC, under Dr. Roth, may be violating federal law requiring maintenance of documents regarding NIH studies as well as evading inspection of public records requests in compliance with state law.  

"Ultimately, Dr. Roth is entrusted to ensure UNMHSC is following the law when it comes to research involving human subjects.  NMAFL along with New Mexico taxpayers need the confidence that is happening at UNM and are afforded their rights to view public documents - especially when it comes to studies involving body parts, tissues and organs that carry blood-borne pathogens and can expose the public to infectious diseases," Elisa Martinez added.

Senate Public Affairs to Hear SB 242 Late-Term Abortion Ban and SB 243 Partial Birth Abortion Ban

TUESDAY: The Late- Term Abortion Ban SB 242 and the Partial Birth Abortion Ban SB 243 will be heard before the Senate Public Affairs Committee at 1:30 PM, room 321, NM Legislature. Last year the Late-Term Abortion Ban passed the state House but died in the Senate Public Affairs Committee.   Contact members of the committee today and tell them to vote with New Mexicans and support both SB 242 and SB 243. 

This common-sense legislation is supported by the vast majority of women, men and New Mexicans but will NM Senate Democrats led by Committee Chair and professed 'Catholic' Sen. Jerry Ortiz Pino and others vote to kill the bill, therefore relegating thousands of  innocent, helpless and viable babies to die at the hands of profiteering late-term abortionists in NM?  


Thousands of constituents in Democrat Sen. Daniel Ivey- Soto's district (Sen. district 15) and also Sen. Bill O'Neill ( Sen. district 13) support NMAFL and our legislative agenda--it is important your Senator hears from you today and in person tomorrow.

As reported by NMAFL, (read more here) all five Senate Democrats on the Public Affairs Committee took campaign cash from POWER PAC: the profiteering late-term abortion industry's political action committee.  Believe it or not, the out-of-state late-term abortionist Curtis Boyd, Eve Espey and others have actually formed their own PAC to influence our state leaders to maintain such an extreme position of abortion on demand for ANY reason up to the day of birth.    Why else would these leaders vote against the will of their constituents?    In fact, despite what the paid pro-abortion lobby claims, the MAJORITY of Albuquerque residents SUPPORT A LATE-TERM BAN, by 54% to 39 %, ALONG WITH THE REST OF THE STATE. It changed only after another out-of state abortion group, Colorado based Planned Parenthood, dumped over $1 MILLION into the Albuquerque election.

The people of New Mexico will be watching how Senate Democrats and the Public Affairs Committee votes on this life and death matter:  either vote with the people of NM or will they vote with the out-of-state pro-abortion extremists and their well funded lobby? The choice is simple, life or death. New Mexicans will not forget come election time in November.

If these Legislators believe babies should be left to die or killed, they do not deserve to hold elected office in our state. 


Thursday, the Health House Committee took public testimony on HB 275 to Require Medical Care for All Infants. Sat., Feb. 6 at 8:30, they will vote on HB 275 (no public testimony, just debate among themselves). Watch online here.

SHOCKING FACT: Due to the lack of any state law that would require medical care be given to infants born alive after a failed abortion--these innocent, helpless newborn survivors can and most likely are being left to die in abortion clinics and hospitals across the state.
The federal Infant Born Alive Protection Act does not require these victims be given medical care or nourishment, which is why the NM Legislature needs to pass HB 275 this year--  to prevent this heinous, almost unbelievable disregard for human life from taking place.
Not only can these newborn babies be left to die --they could be intentionally killed, like 
convicted late-term abortionist Kermit Gosnell who snipped the spinal cords of babies who came out alive during abortions-- some would let out whimpers others screams. The late-term abortion method he used called "induction" abortion can result in a live birth, since the birthing process is unnatural and uncontrolled and can take anywhere from 2-7 days for women to deliver. Protocols for this outlined by UNM OB-GYN Dept Chair Eve Espey who also serves as Director for UNM's late-term abortion clinic clearly indicate this occurrence of infants born alive, but again, NMAFL and taxpayers of New Mexico ask, what care is provided to these babies? Are they left to die in a utility room without comfort or nourishment? Are they just set aside or intentionally killed?   This is simply unacceptable, and NMAFL along with New Mexicans across the state demand basic human rights be upheld by passing HB 275 "Require Medical Care for All Infants."

As in the case of Kermit Gosnell and others, a crying, frightened newborn baby inside an abortion clinic is bad for business, he opted to snuff out their lives by various cruel and barbaric means, including snipping their spinal cords. What is happening inside Southwestern Women's Options late-term clinic or University of New Mexico's late-term clinic?  Are these babies leaving the clinics alive? Are they set aside somewhere inside the abortion clinic?  The majority of late-term abortions are elective and in New Mexico the rate is 5 times the national average according to the CDC. 

Sadly, pro-life New Mexicans did not show up in great numbers for the first committee hearing of this historic, humanitarian legislation.  This issue has nothing to do with so called "abortion rights" however the rabid, pro-abortion crowd and their paid activists did show up, and displayed all levels of histrionics in opposition: "this bill will create a police state,"  "this bill is insidious" or making misleading statements like, "this bill will interfere with the relationship between a woman and her doctor." 

Those, including multiple physicians, in favor of the bill made fact-filled statements as to why children who survive abortion are innocent victims and should be given basic medical care and nourishment. How can anyone in their right mind be so cruel as to deny a newborn baby medical care and nourishment?  This reveals the extreme, unsympathetic and unflinching disregard the pro-abortion industry and their activists have for these newborn victims.  Babies who didn't ask to be killed, who don't have a voice-- except for those who will stand up and fight for them, who will be their voice? 

WILL YOU BE A VOICE FOR THESE HELPLESS VICTIMS?

There are less than two weeks left to get this bill through the House and Senate, follow NMAFL updates for information.    

3) Contact members of the Health House Committee, your state  Rep.and state Senator today and tell them to vote YES on HB 275 or you will work to vote them out in November.  Its that simple.

HB 275 A Result of New Mexico Alliance for Life Investigation Into UNM Health Sciences Center Policy for Babies Born Alive After Abortion Procedure

HB 275 will have first committee hearing on 
Thursday, February 4 in House Health Committee at 8:30 a.m. in Room 309, NM State Legislature

New Mexico Alliance for Life has worked with state leaders to introduce this ground breaking legislation and thanks Gov. Susana Martinez for messaging HB 275 "Require Medical Care for All Infants" and thanks to the bill sponsors Rep. Rod Montoya (R- Farmington)  and Rep. Yvette Herrell (R-Alamogordo). This bill will ensure infants who survive abortion attempts on their lives receive proper medical attention and are not left to die, or intentionally killed. The NMAFL-draft legislation provides oversight to ensure the federal Infant Born Alive Protection Act is adhered to but also ensures infants who survive abortions in New Mexico are provided proper medical care.  It is well documented that during abortion procedures, in particular late-term abortions infants are born alive and may survive--which spurred the passage of the Federal Infant Born Alive Protection Act in 2002, that grants these babies all the rights of a U.S. citizen under the law.

As a part of New Mexico Alliance for Life's ongoing investigative research, we have uncovered an infants born alive policy at the University of New Mexico Health Sciences Center.  HB 275 is the direct result of our findings and recommendations in working with the Governor's office and other state leaders to address this alarming issue, which currently has gone unchecked.  

NMAFL has uncovered the University of New Mexico's OB-GYN Dept. Director and UNM late- term abortion clinic director, Eve Espey outlines how infants show signs of life after late-term abortions but does not indicate how they are cared for.  What is truly alarming is the policy uncovered by NMAFL does not indicate how these babies are being cared for inside the abortion clinic or UNM Hospital--alive, crying, frightened and fighting for their lives. "The question is not a matter of "if" this is happening but when it does, what provisions are being provided to these babies born alive in abortion clinics across New Mexico?" said Elisa Martinez, executive director of NMAFL.   As exposed by NMAFL, Espey also set up the invalid contract with late-term abortionist Curtis Boyd which resulted in the disbanding of UNM resident training at his clinic.  

This bill will provide the necessary oversight to prevent another Kermit Gosnell, late-term abortionist convicted of three counts of murder who delivered babies who were still moving, whimpering or breathing, that he and his assistants "snipped" the newborns' spines with scissors.  Or late-term abortionist Douglas Karpen, whose former assistants accused him of killing "three to four born-alive babies a day by cutting their spinal cord, forcing instruments into the soft spots of their heads or even twisting their heads of their necks."

CDC Statistics On Babies Born Alive After Failed Abortions 

In 2011, the CDC recorded 1,298 cases of infant death in the U.S. due to "Other perinatal conditions," which includes ICD-10 category P96.4, death subsequent to a failed "termination of pregnancy." Numbers have not been released for the particular category.  Currently there is no "reliable voluntary reporting of live birth" after abortion. Dr. Willard Cates, an expert on medical statistics who is chief of abortion surveillance for the Center for Disease Control in Atlanta, estimates that 400 to 500 abortion live births occur every year in the United States. Dr. Cates added, "No one is so naive as to think there is reliable voluntary reporting of live births in the present climate." In other words, the number of babies born alive after abortions is actually much higher.

About HB 275

HB 275 provides oversight measures and a special task force that will report to the legislature and Governor every year to monitor abortion clinics to ensure they are providing care to children that are born alive after a failed abortion attempt.  This includes medical care and nourishment for the victims who show signs of life after an abortion attempt and where their death is not imminent.
