Pro-Life Victories Sweeping the Nation, What About NM?
Major pro-life victories took place across the country this week: Alabama's Governor signed a historic abortion ban designed to challenge the problematic findings of Roe v. Wade, Missouri's Senate passed a heartbeat bill and Louisiana's heartbeat bill is also advancing.
"We celebrate the challenges Alabama's abortion law and others present to the unjust and unconstitutional aspects of Roe v. Wade. Roe created a right that does not exist in the Constitution and forced abortion up-to-birth extremism on the American public, without ever being voted on by the people, passed through the legislative process or signed into law by any President. Many pro-choice legal scholars agree: Roe v. Wade was based upon unconstitutional findings, and in the words of pro-choice Justice Ruth Bader Ginsberg: "Heavy-handed judicial intervention was difficult to justify and appears to have provoked, not resolved, conflict." New Mexico Alliance for Life Analysis: What About New Mexico?
We celebrate the advancement of pro-life legislation designed to challenge the unjust findings of Roe v. Wade. What we can expect: the ACLU, Planned Parenthood and other abortion industry groups will sue the state(s) and over time, the cases will make their way through federal circuit courts up to the U.S. Supreme Court.
Unfortunately, in New Mexico a 1998 court ruling by the NM State Supreme Court created a "right to abortion" via the state's Equal Rights Amendment, thereby establishing this bad "case law" as the law of the land in NM.
This is why NMAFL fights on the front lines at our Legislature and is committed to drafting legislation designed to uphold court challenges at the state level and at the federal circuit court. While other states are in a position to challenge court decisions, sadly New Mexico's laws and court rulings will not change-- until we elect pro-life leaders including fair-minded judges who will interpret law, rather than create it. This is why it is important you stay informed and use our Pro-Life Voter Guide during election season, which includes judicial races.
Remember 2015 New Mexico Alliance for Life has been leading the charge on pro-life issues at the NM Legislature -- since we began our work in 2015. In 2015, with a pro-life majority in the NM House, we made history by passing a 5-month ban on abortion up-to-birth along with a parental notification bill.
Both bills were drafted by NMAFL’s legal experts to withstand legal challenges in the NM courts and beyond-- however, both bills died in the Senate Public Affairs committee chaired by abortion up-to-birth “Catholic” Senator Jerry Ortiz y Pino.
Sadly, New Mexico is light years away from pro-life states like Georgia, Ohio or even Arizona.

If New Mexicans continue to elect pro-abortion leaders like Michelle Lujan Grisham, House Speaker Brian Egolf, and others, we’ll never see any advancement in protections for the unborn.” -- Rep. Rod Montoya. Next Steps We must also look at the battle with a long term commitment to the process of supporting pro-life leaders and working to get more pro-life leaders elected.
