BREAKING: Jessica Duran Lawsuit Against Late-Term Abortionist Goes ForwardJudge Says UNM Not Authorized to Use Aborted Baby Parts for Research Last week, Albuquerque District Judge Clay Campbell denied a motion by late-term abortionist Curtis Boyd and his business, Southwestern Women's Options (SWO), to dismiss a lawsuit filed by Jessica Duran. Duran claims SWO deceived her about its relationship with UNM. Judge Campbell ordered that all seven causes of action in Duran's lawsuit, including the unauthorized harvesting of her infant's body parts for research at the University of New Mexico (UNM), should go to trial and be decided by a jury. "This is a monumental finding by the court," said Elisa Martinez, executive director of the New Mexico Alliance for Life. "It shows the University of New Mexico was not authorized to do any research using aborted infant bodies from Curtis Boyd's abortion business, and thousands of women were deceived who now deserve justice." The story is covered today by the Albuquerque Journal and other outlets (read more below). |
❌ Pro-Abortion (up to the day of birth). Keller has previously taken campaign cash from late-term abortionist Curtis Boyd. He is endorsed by various pro-abortion groups like Planned Parenthood, Nasty Women NM and others. Don't be misled as Keller's campaign materials boast attending St. Pius and Notre Dame Catholic schools. However, as a 'Catholic' Keller endorsed Respect ABQ Women in ABQ elections to keep abortion legal through all 9 months for any reason and more. Read below on Keller's deep ties to the abortion industry. |
❌ Pro-Abortion. Colon has taken thousands of campaign dollars from his long-time friend, Attorney General Hector Balderas. As NMAFL has reported, Balderas has protected the abortion industry over women by allowing over 100 criminal complaints against Southwestern Women's Options late-term abortion business and UNM Health Sciences Center to expire. Read more on Colon's alignment with the abortion industry below. |
✔️Pro-Life. Dan Lewis was the first mayoral candidate to issue a public pro-life statement. As city councilor, Lewis fought alongside pro-life groups and was instrumental in getting the 2013 late-term ban on the ABQ city-wide ballot. "As a City Councilor, I fought hard and was very publicly vocal about my stance on abortion and specifically late-term abortion. I worked with life groups to ensure the question would be on the ballot, voted for the election resolution that created the ballot question, and ultimately put it before the voters. As Mayor, I will take seriously my responsibility to ensure all facilities within our city, including abortion clinics, that provide medical health and safety services to our residents and visitors are in compliance with required business and health regulations. To that end, our Solid Waste Department inspects and reviews Infectious Waste disposal practices, the Zoning Enforcement Division inspects and reviews facilities in the City to determine whether their activities are within permitted uses under the current code or its variances, and the Environmental Health Department and Code Administration Division ensures proper disposal of waste products and inspects premises for insect and rodent infestations." Read Dan's response to NMAFL's questionnaire here. |
✔️Bernalillo County Commissioner Wayne Johnson has stated that he is, "staunchly pro-life, supporting parental notification and opposing late-term abortions." Read Wayne's response to NMAFL's questionnaire here. |
✔️Pro-Life. Michelle Garcia Holmes served as Chief of Staff under attorney General Gary King and released the following statement: "I'm pro-life because life is precious, children are precious. Each and every baby should be wanted, these are children, they are someone's son, someone's daughter. I have a strong faith and belief system that tells me we cannot separate our faith and ideological beliefs on this issue. My faith guides me to have mercy, compassion, forgiveness, and to care for the most vulnerable. Life is precious." |
✔️Pro-Life. "The fact that Albuquerque is known as the "late term abortion capital of the country" is disheartening and disgusting. I am openly vocal about my pro-life beliefs and won't shy away from letting people know where I stand. I'd use the full weight of the mayor's office and the media to pressure Attorney General Hector Balderas to act on the investigations and findings that were presented to his office recently. Hector Balderas has endorsed Brian Colon's candidacy for mayor, so you know these two would continue to encourage this awful behavior. They are cheerleaders of the abortion industry and their practices, and have raised lots of money for these abortionists. I would also be vocal about changing the perception that we as a city embrace these actions. The mayor can also send health and building inspectors to make sure that these clinics are following the law. We could also look at the zoning laws in the area of the clinic. With the support of organizations like New Mexico Alliance for Life, we can pressure the ABQ City Council to rezone these areas for other uses." Read Ricardo's response to NMAFL's survey here. |
Pro-Abortion 'Catholics' Brian Colon and Tim Keller
In 2013, then-state senator Tim Keller actually endorsed "Respect ABQ Women," a group pushing to keep abortion legal up to the day of birth in the Albuquerque city election. Tim Keller has also received endorsements from radicalized pro-abortion groups Planned Parenthood, Nasty Women New Mexico and endless favorable press from pro-abortion media like "ProgressNow NM."
In fact, Keller was a featured guest presenter at ProgressNow's "Progressive Summit" earlier this year, where a who's who of pro-abortion groups convened to discuss "abortion access" in NM and other issues. Read more here.

Brian Colon donated to the Southwest Women's Law Center, in honor of their high dollar pro-abortion lobbyist, "Julie Koob's good work." At the same time, Koob was hired by SWLC to "ensure that full reproductive health services are still available in Santa Fe despite the Catholic hospital merger there imposing religious restrictions on access to contraception." Koob is well known in Santa Fe at the legislature as a seasoned, pro-abortion lobbyist who works for clients like the ACLU, Planned Parenthood, SWLC and others.
Colon has also taken thousands of campaign dollars from his long-time friend, Attorney General Hector Balderas. As NMAFL has reported, Balderas has protected the abortion industry over women by allowing over one hundred criminal complaints against Southwestern Women's Options late-term abortion business and UNM Health Sciences Center to expire. BREAKING:
Congressman Pearce Calls On U.S. Attorney General to Investigate University of New Mexico Health Sciences Center and Southwestern Women's Options Late-Term Abortion Business
ALBUQUERQUE: As New Mexico Attorney General Hector Balderas allows valid claims to expire daily, Congressman Steve Pearce issued a statment yesterday calling on U.S. Attorney General Jeff Sessions to investigate Southwestern Women's Options (SWWO) late-term abortion business and University of New Mexico Health Sciences Center (UNMHSC). Pearce cited the violations of law identified by the Select Panel on Infant Lives' criminal referrals for both UNMHSC and SWWO. The Panel found numerous violations of both state and federal law in the harvesting of aborted infant body parts for research between SWWO and UNMHSC. From Pearce's letter to the U.S Attorney General:
"We formally request your office conduct an investigation on UNMHSC and SWWO practices related to the Panel's findings... We also ask that your office prosecutes, to the fullest extent of the law, any violations that are uncovered. It is entirely unacceptable for these institutions to continually violate 42 U.S. Code § 289g-2 as well as other state and federal laws, especially in-light of the interstate commerce that is generated from these abortions and the research that is conducted with the subsequent fetal tissue."
New Mexico Alliance for Life (NMAFL) consulted with the Panel and provided thousands of documents resulting in the two criminal referrals issued for UNMHSC and SWWO. NMAFL has also raised the issue of claims involving baby brains, hearts and skin expiring by NM Attorney General Hector Balderas, protecting the abortion industry over women and unborn children.
"It has been over a year since NM Attorney General Hector Balderas received the criminal referrals from Congress evidencing massive violations of the law--yet he has done nothing but allow over one hundred claims to expire," said Elisa Martinez NMAFL executive director. "We will continue working with Congressman Pearce on these issues and applaud his stand in demanding justice on behalf of New Mexico women and unborn children who have been left behind by Hector Balderas."
You can read the letter sent by Congressman Pearce to the Office of the U.S Attorney General here.

Pro-Abortion 'Catholic' Candidates for Mayor Align With the Abortion Industry
With the Albuquerque mayoral race heating up, its important to know who the candidates represent and where they stand. NMAFL will be releasing important information on various candidates leading up to October's election. Recently, it has been noted that two pro-abortion mayoral candidates have been courting Catholic voters, all the while aligning with radical pro-abortion up to the day of birth activists and groups: Democrats Brian Colon and Tim Keller.
Candidate: Brian Colon
Pro-abortion candidate for mayor and 'Catholic' Brian Colon attends St. Therese Catholic church in Albuquerque, but supports radicalized, anti- Christian, pro-abortion organizations like the Southwest Women's Law Center. In fact, Colon donated to SWLC, in honor of their high dollar pro-abortion lobbyist, "Julie Koob's good work." At the same time, Koob was hired by SWLC to "ensure that full reproductive health services are still available in Santa Fe despite the Catholic hospital merger there imposing religious restrictions on access to contraception." Koob is well known in Santa Fe at the legislature as a seasoned, pro-abortion lobbyist who works for clients like the ACLU, Planned Parenthood, SWLC and others.

As NMAFL has reported, Balderas has protected the abortion industry over women by allowing over one hundred criminal complaints against Southwestern Women's Options late-term abortion business and UNM Health Sciences Center to expire. Despite hundreds of pages of evidence prepared by federal prosecutors, rather than prosecute, Balderas has chosen to protect the abortion industry over women.
As the New Mexico Democratic Party chairman, Colon also helped a number of pro-abortion up to the day of birth candidates get elected to higher office, including Martin Heinrich, Tom Udall and Ben Ray Lujan in 2008. In 2010, Colon r an on a pro-abortion ticket as Lt. Governor with radical pro-abortion candidate Diane Denish--a founder of the Southwest Women's Law Center and board member of Planned Parenthood of the Rocky Mountains.

Candidate: Tim Keller
Like Colon, mayoral candidate Tim Keller has numerous connections to radicalized pro-abortion activists and organizations, all the while claiming to attend Holy Ghost Catholic Church in Albuquerque, according to his social media accounts. As NMAFL's Elisa Martinez reported back in 2014, 'Catholic' graduate of St. Pius High School and the University of Notre Dame: Tim Keller
has received campaign cash directly from late-term abortionist Curtis Boyd, owner of scandalized Southwestern Women's Options late-term abortion business.
In 2013, then state senator Tim Keller actually endorsed "Respect ABQ Women," a group pushing to keep abortion legal up to the day of birth in the Albuquerque city election.
'Catholic' Tim Keller has also received endorsements from radicalized pro-abortion groups Planned Parenthood, Nasty Women New Mexico and endless favorable press from pro-abortion media like "ProgressNow NM." This week, New Mexico Attorney General Hector Balderas has allowed seven additional criminal claims to expire due to the statute of limitations, in the unlawful harvesting of aborted infant body parts between the University of New Mexico Health Sciences Center (UNM HSC) and Southwestern Women's Options (SWO) late-term abortion center. The seven criminal claims come from the congressional criminal referral, received by Balderas a year ago this month, from the Select Panel on Infant Lives.
This week's expired claims come from the illegal harvesting of eyes, brains, hearts and even SKIN from aborted infants 16 weeks gestation through 22 weeks.
Last week, NMAFL held a press conference calling for a special prosecutor due to Balderas' inaction-- allowing 83 claims expire. This week, the AG's office filed a lawsuit against Dollar General, while allowing 7 additional claims involving human skin and brains expire, for a total of 90: "My office continues to aggressively protect hard working New Mexico families and vulnerable consumers by holding big corporations like Dollar General accountable for preying on them and lying about the quality of the products that they sell," Balderas said.

Tell Balderas he can't pick and choose what laws and whom he will "hold accountable." Read more below.
"Women whose babies' skin was illegally harvested for UNM's purposes, by law should have been informed of the nature of the research and its benefits--yet they were not informed, they were deceived," said NMAFL's Martinez. "This is a serious violation, how many of these women would have chosen life, deceived about the humanity of their babies, which is the very reason their bodies were harvested for research." CLAIMS CONTINUE TO EXPIRE EACH WEEK
Balderas has allowed these claims to expire by failing to issue indictments in the face of overwhelming evidence of violations of New Mexico statutes, but also failing to contact victims, including Jessica Duran. Requests by NMAFL's Executive Director Elisa Martinez to set up meetings between Jessica Duran and the Office of the Attorney General have been postponed indefinitely by the Attorney General's office.
What You Need to Know
- Balderas received 1st criminal referral on June 23, 2015.
- Balderas received 2nd criminal referral on Dec. 21, 2015.
- Federal prosecutors cite "systemic violations" of law between UNM HSC and SWO in both referrals.
- Balderas has not contacted victim cited in 2nd criminal referral, Jessica Duran and others.
- Criminal claims will continue to expire due to the statute of limitations to prosecute until Balderas issues a criminal complaint.
Despite overwhelming evidence in his possession since last year, including an admission of guilt from SWO abortionist, Balderas has yet to file a criminal complaint (indictment).
Live Action reports:
Extracting skin from aborted babies sounds more like a Nazi experiment rumor than a modern day medical procedure, yet UNM's own procurement notebook, released by the congressional committee investigating the university show that it was all in a day's work for researchers at UNM or their procurement technicians at the abortion facility. Procurement technicians locate, remove, and bring back the organs, legs, skin, eyeballs, head, or other body parts of aborted babies.

Yesterday, New Mexico Alliance for Life, New Mexico Right to Life, Michelle Garcia Holmes former Chief of Staff for the Office of the Attorney General, and Students for Life participated in our press conference, calling for a special prosecutor to investigate claims of illegal aborted baby body part harvesting by the University of New Mexico (UNM). This comes on the date the statute of limitations runs out on seven month baby brains harvested by a UNM doctor "to dissect w/summer camp students" in 2012.
"Attorney General Balderas has allowed 83 criminal claims to expire since receiving Congress' 300-page criminal referral in June of last year," said Elisa Martinez, Director of New Mexico Alliance for Life. Read more below about what you can do to help.
Martinez read a statement by Congressman Steve Pearce, "It is unacceptable that New Mexico's Attorney General Hector Balderas is taking a buffet style approach to the laws he chooses to enforce and those he does not. He is allowing criminal claims against the University of New Mexico to expire, ignoring all sense of responsibility and duty that he owes to the women, children, people, and rule of law here in New Mexico."
"Each week that goes by, Balderas allows criminal complaints to expire and women are denied justice," concluded Martinez. "Balderas doesn't care about women, so it is time for the state to appoint a special prosecutor to do his job for him."

The Albuquerque Journal has more:
In this incident, which happened in 2012, UNM Health Sciences faculty members sought whole fetal brains supplied by an abortion clinic so the brains could be dissected for "summer camp students," according to the panel report. The group and panel allege this violated state law. UNM officials at the time acknowledged that a six-week "Neuroscience Summer Experience" in 2012 and 2014 involved fetal brain dissections. They said it was not a camp, but an educational research program.
In addition, Martinez said at least one of the two abortion clinics in the state has violated the law with consent forms. Citing a 2012 consent form, she said the form a woman must sign to authorize an abortion procedure at Southwest Women's Options also includes the consent for the tissue to be donated for scientific research, so a woman then is limited in her choice because she cannot authorize the abortion and decline the research.
"Their right to choose was violated," Martinez said. "The fundamental rights of women must be protected."

BREAKING: Brain harvesting scandal leads to call for special prosecutor
ALBUQUERQUE: New Mexico's leading pro-life group is calling for a special prosecutor to investigate claims of illegal aborted baby body part harvesting by the University of New Mexico (UNM). The call comes a day before a statute of limitations runs out on baby brains harvested in 2012.
"Five years ago tomorrow, the University of New Mexico unlawfully ordered the brains of a seven-month aborted baby to dissect with summer camp students," said New Mexico Alliance for Life (NMAFL) Director Elisa Martinez. "Dr. Paul Roth, Chancellor of the UNM Health Science Center, has admitted that UNM obtained these brains, which were never used for research."
"There is ample evidence that UNM has broken state law by collecting these aborted baby parts without lawful consent from the mothers of the children," continued Martinez. "Yet Attorney General Hector Balderas refuses to do the basic duty of his office and investigate what's really going on behind the taxpayer-funded university's closed doors."
"This is malpractice," said Martinez, whose organization provided key information that led to criminal referrals against UNM and late-term abortion center Southwestern Women's Options (SWO) by a Congressional committee. "Taxpayers deserve better than this, which is why NMAFL is formally calling for a special prosecutor to investigate UNM and Southwestern Women's Options."
Under New Mexico law, the Maternal Fetal and Infant Experimentation Act (MFIEA) requires a six-point consent process for fetal tissue donation. Additionally, the Jonathan Spradling Revised Uniform Anatomical Gift Act prohibits the donation of fetal tissue for research. Both laws were cited in the Congressional committee's referrals.
Violations of the Spradling Act are third-degree felonies punishable by up to a $5,000 fine and/or six years in prison. The statute of limitations on such a crime is five years, which in the case of the procured brains is May 24, 2017.
In deposition testimony, a UNM-trained Southwestern Women's Options abortionist admitted she had never obtained consent from a patient at Southwestern to make a fetal tissue donation nor was familiar with the consent form allegedly used at the abortion center. A different woman who went to SWO for an abortion sued the center late last year, claiming that she was never informed that it would send her child's body parts to UNM.
"Attorney General Balderas has allowed 59 criminal claims to expire since receiving Congress' 300-page criminal referral in June of last year," said Martinez, who noted that a total of 82 claims have expired while Balderas has been in office.
"Each week that goes by, Balderas allows criminal complaints to expire and women are denied justice," concluded Martinez. "Balderas doesn't care about women, so it is time for the state to appoint a special prosecutor to do his job for him."
The New Mexico Alliance for Life is a nonpartisan organization focused on changing state and local laws by empowering women with better and informed choices when facing unplanned or difficult pregnancies and advocating for better protections for women and unborn children from an unsafe abortion industry.

Congressmen Pearce, Blackburn Address Criminal Referrals for
University of New Mexico, Southwestern Women's Options
ALBUQUERQUE: Today, Congressman Marsha Blackburn, Chairman of the Select Panel on Infant Lives and Congressman Stevan Pearce lead a coalition of pro-life New Mexico leaders to address the two criminal referrals the Panel issued last year. The Panel's referrals citied numerous violations of federal and state law between the University of New Mexico and Southwestern Women's Options late-term abortion center.
"At the core of our investigation was a federal statute, USC 289g(2), which deals with receiving money and funds for research and how human tissue is transferred," said Congressman Blackburn. "To receive even one penny of profit, is a ten year felony offense."
The Panel issued a criminal referral to Attorney General Balderas, which cited violations of 42 USC 289g(2) between the University of New Mexico and Southwestern Women's Options. The Panel also issued a second criminal referral citing systemic violations of NMSA 24-9-A-1, based on a lawsuit filed by a New Mexico woman and documents submitted by NMAFL.
"Today we call on everyone who claims to respect women's rights, to stand with us and demand justice and action," said Elisa Martinez, executive director of New Mexico Alliance for Life. "Thousands of New Mexico women's rights have been violated, as they were not provided a legal and valid informed consent to donate infant body parts for UNM research."
New Mexico Alliance for Life has provided the Select Panel thousands of documents obtained by New Mexico's Inspection of Pubic Records Act (IPRA) from the University of New Mexico. To date, the Attorney General Hector Balderas has made no public commitment to a formal investigation of the criminal referrals. Congressman Pearce and pro-life leaders called on Balderas to take decisive action. View video of the press conference here.

NM 2017 Legislative Session Adjourns, Anti-Life Bills Defeated
Progressive Measures Backed By Out-of-State Special Interests Lose in NM
Sine Die: On Saturday, March 18th the New Mexico 2017 legislative session adjourned. With your help, we were able to defeat a number of extreme, anti-life measures, backed by out-of-state special interests! SB 282 and HB 473 never made it to debate on the Senate and House floor, respectively.
Thanks to your phone calls, emails and hard work, SB 282, the so-called 'Hospital Patient Protections Act,' died. SB 282 was sponsored by 'Catholic' Jerry Ortiz y Pino and would have forced Christians health care professionals to refer patients for abortions and religiously-affiliated hospitals to perform abortions across New Mexico.
Also, HB 473, the 'Decriminalize Abortion Act', was sponsored by House progressives: Speaker Brian Egolf (HD- 47 Santa Fe), Deborah Armstrong (HD 17- ABQ), Christine Trujillo (HD-25 ABQ), Joanne Ferrary (HD-37 Dona Ana), and Harry Garcia (HD-69 Grants). This bill was an aggressive abortion measure that aimed to decriminalize abortion, allowing non-physicians to perform abortions. Sadly, the unconstitutional measure also sought to remove New Mexico statute that protects healthcare providers from participating in an abortion against their religious or moral objections.

OTHER VICTORIES FOR LIFE
These victories could not be possible without your help! Physician Assisted suicide, in the form of HB 171 and SB 252, the 'End of Life Options Act', also failed in both the Senate and House. House progressives led by Speaker Egolf, refused to allow a vote on HB 171 in the House Judiciary Committee because they knew it would fail--even with a majority of Democrats. SB 252 was killed on the Senate floor in a bipartisan 22 - 20 vote, with six Democrats and 16 Republicans voting against the measure.
A big 'thank you' to all our pro-life champions in the legislature, our coalition partners including the American Academy of Medical Ethics, The NM Conference of Catholic Bishops, Right to Life Committee of New Mexico, the HUB of New Mexico and all who showed up to testify, send emails, and make phone calls. As we continue to work together in a unified effort, we will see New Mexico change from a culture of death to a culture of life.
